Commercial Rental Licence (excluding Public Performance)

1. Scope of Tariff
This tariff shall apply to suppliers of music equipment and/or sound recordings/music videos and excludes all uses other than for the purpose of hiring music equipment and/or sound recordings/music videos to third parties as part of licensee's business or commercial activities. "Public Performance" of sound recordings at any premises or events is NOT licenced under this tariff.
2. Licence Period
The Licence shall be deemed to have commenced on the day in which you commenced business, except where stated otherwise in writing by PPM. The Licence shall remain in force for a period of twelve (12) months from the date of commencement of business and will be renewed yearly unless otherwise agreed to in writing by PPM.
3. Licence Fees
This Tariff comes into effect on 1 January 1999. The licence fees shall be on a per annum basis per complete set of music equipment and/or sound recordings and payable in advance or such other basis as shall be agreed in writing between PPM and the licence. The licence fee payable are as follows :
A Licence - RM 3,000 per annum
B Licence - RM 1,200 per annum
C Licence - RM 250 per day per venue per event
Jukebox Operator - RM 120 per jukebox per annum
4. Definitions
A Licence - Licence for renting sound recording, music videos and/or karaoke to third parties as part of
licensee's business or commercial activities for performances at any premises.
B Licence - As per A licence BUT excluding performances at Hotel Ballrooms / Public Halls / Complexes.
C Licence - Where the music supplier do not have a A licence or B licence, the music supplier OR the event
organiser must apply for the C licence for that particular event.
Jukebox Operator - Licence for renting jukeboxes as part of licensee's business or commercial activities.
5. Inspection by PPM
PPM by its duly authorized employees or agents shall have the right of free entry into licence's premises where the event is held at all reasonable hours for the purposes of inspecting the music equipment, sound recordings or music videos.
6. Assignment
This Licence shall not be assigned or otherwise transferred in whole or in part. The
licensee agrees not to edit, reproduce, re-mix, re-record or alter any sound recordings and/or music videos whose copyright vests in and/or controls by PPM. Licensee further agrees not to infringe any copyright subsisting in the sound recordings/music videos.
